Metropolitan Tribunal of the Archdiocese of the United States

An ecclesiastical system of justice is absolutely necessary in the Church in order to preserve justice and the rights of all Christians, clerics and lay people alike, to due process of canon law. In the Old Catholic Confederation, the judicial system begins with the local Diocesan Tribunal, which acts in the name and the authority of the local bishop. 


The Metropolitan Tribunal is the local Ecclesiastical Tribunal for the Archdiocese of the United States and the Ecclesiastical Court of Appeals for the Archdiocese of the United States and its Suffragan Dioceses. 


The Supreme Tribunal of the Synod of Bishops is the highest and final Ecclesiastical Court of Appeals for all Metropolitan-Archdioceses, Dioceses, Vicariates, Religious Orders and other jurisdictions of the Old Catholic Confederation. 


Nota Bene:  There must first be a judgment by a local Diocesan Tribunal before the Metropolitan Tribunal can be petitioned.

NOTICES

Canon 901: All priests of the Confederation are required to petition from their local bishop an ecclesiastical divorce for any person requesting Holy Matrimony when there has been a previous marriage and a civil divorce.

 

ECCLESIASTICAL DIVORCE

The Old Catholic Church acknowledge that because of sin, marriages do not always result in happiness. Thus, based upon a pastoral decision, after prayer, penance and discernment of the married couple, the Metropolitan Tribunal is authorized to canonically dissolve the vows of the married couple and decree an ecclesiastical divorce (only when a civil divorce has already been granted) in the name and by the authority of the local bishop who has the authority to do so by his Apostolic Office.
